Universal Service Agreement and Privacy Policy

Unless otherwise specified by written contract - the below terms constitute a Universal Service Agreement ("Agreement") between Alastair Grace, LLC DBA Piper Jonas ("Piper Jonas") and any and all past, current, and future clientele ("Client" or "Clients") seeking Piper Jonas' services. This Agreement is entered into upon the Clients first payment to Piper Jonas.
I. Services
Piper Jonas shall provide traditional and/or contemporary bagpiping services for Clients at a time, date, and location mutually agreed upon by the Client and Piper Jonas, hereafter referred to as (the "Service").
II. Payments
Payment is due at the time of booking for Services taking place within 60 calendar days from the client’s first inquiry. Upon confirming scheduling availability and agreement on the price and terms, Piper Jonas will issue an invoice outlining the terms and options for payment. The fee can be paid directly through links in the invoice.
Performances scheduled to take place 60 days or more from the client’s first inquiry may be eligible for splitting payment into two transactions: 1) a non-refundable deposit, and 2) the remaining balance. Eligibility is determined at the sole discretion of Piper Jonas. The reservation deposit confirms the date and time in the booking calendar.
Reservation deposits will be $100 or 30% of the total amount due (whichever is greater) and is due immediately to reserve the performance date. Until a reservation deposit is paid, the date is considered "non-reserved" and available for booking by others on a first come, first serve basis.
Piper Jonas will provide the Client an invoice with the total balance due specifying the payment terms. In those instances that are eligible for a reservation deposit, the deposit amount will be specified with the remaining balance due on or before the day of the Service.
All payments are considered non-refundable and all amounts paid under this Agreement will be in U.S. Dollars or Bitcoin.
III. Delinquent and Late Payments
Payments are considered past due the day following the date of the event. Piper Jonas will work with clients in good faith to resolve any issues or delays that could result in a late payment, but communication is an important part of the process. Invoices that remain unpaid one (1) week following the date of the event accruing compounding weekly late fees at 5% of the total invoiced amount. Late fees will continue accruing until the late fees reach 50% of the total invoiced amount.
IV. Termination
Force Majeure: The parties reserve the right to cancel this agreement without notice in the event of force majeure or exigency caused by events beyond the reasonable contours of either party, including but not limited to acts of God, embargoes, governmental restrictions, strikes, subcontractor failures or delays, riots, wars or other military action, civil disorders, rebellion, vandalism, sabotage, or weather conditions affecting the facility or scheduled performance. The parties shall promptly notify each other of such force majeure occurrence or exigency. In the event of cancellation by force majeure, this Agreement is totally null and void with no additional monies due by the Client.
Termination for Default: If Piper Jonas fails to fulfill his obligations under this Agreement properly and on time, or otherwise violates a provision of this Agreement, Client may terminate this Agreement by written notice to Piper Jonas.
Termination for Convenience: This Agreement may be terminated by Client upon written notice to Piper Jonas on any date prior to the date of the Services. Any payments — whether reservation deposits or full balances will remain non-refundable.
V. Video/photography authorization
Piper Jonas hereby grants Client permission to make visual and/or sound recordings (or have others make such recordings on their behalf) during the Services in this Agreement. Piper Jonas hereby grants Client a perpetual, royalty-free right and license to use the recordings for personal use. Client grants Piper Jonas a nonexclusive, nontransferable, perpetual and fully paid license to use the recordings to promote and otherwise market Piper Jonas' work on Piper Jonas' website and/or social media.
VI. Tennessee law prevails
The laws of the State of Tennessee shall govern the interpretation and enforcement of this Agreement. All disputes arising out of or related to this Agreement shall be resolved in Williamson County by the courts of the State of Tennessee.
VII. entire agreement
This Agreement represents, in its entirety, the understanding of the parties and with respect to the subject matter of this Agreement, superseding any prior oral or written understandings. No subsequent agreements of modifications hereof, whether expressed or implied, shall bind the parties unless the same be in writing and signed by the parties. This Agreement may be amended only with the written consent of all parties.
VIII. agreement controls
It is agreed that any attached agreement, or rider(s) thereto, by and between Client and Piper Jonas pertaining to this Agreement is supplemental and subordinate to this Agreement. The terms and conditions of this Agreement shall at all times and in all events and situations be controlling in the event of a conflict.
Privacy Policy
This Privacy Policy describes Piper Jonas' practices regarding the collection, use and disclosure of the information collected from and about you when you use web-based forms to submit personal information. Obligations regarding your privacy are taken seriously and have made every effort to draft this Privacy Policy in a manner that is clear and easy for you to understand. By submitting personal information for the purposes of establishing contact with Piper Jonas, you agree to this Privacy Policy.
Our Collection and Use of Information
Information You Provide to Us
We collect personal information, such as your name and email address, when you subscribe to our emailing list or submit a request for a service quote. Your name, email address and any optional profile information that you elect to associate with your request is referred to herein as your “personally identifiable information” or "PID".
If you decide to hire Piper Jonas, we will utilize a third party credit card payment processing company to collect payment information, including your credit card number, billing address and phone number. We will share this payment information with the third party processing company as detailed below in “How We Share Your Information: With Trusted Service Providers and Business Partners.” We do not store your payment information.
We may use your email address to send you notices (including any notices required by law, in lieu of communication by postal mail). We may also use your email address to send you announcements and information that you may be interested in (together, the “Marketing Messages”). You may opt-out of receiving Marketing Messages at any time by following the instructions provided in the Marketing Message.
Even if you do not contact us via the website, if you email us we may retain a record of such email communication, including your email address, the content of your email, and our response.
Information We Collect Automatically
We use technologies like cookies and pixel tags to provide, monitor, analyze, promote and improve the website. For example, a cookie is used to remember site visitations to improve our understanding of how visitors interact with the website or for remarketing lists.
Log Files
When you use the website, our servers automatically record certain information in server logs. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the website, domain names, landing pages, pages viewed, mobile carrier, and other such information. Log files help us to monitor, analyze, improve and maintain the website and to diagnose and fix any website-related issues.
Device Identifiers
When you access the website using a mobile device, we collect specific device information contained in your mobile device’s “device identifier.” This identifier includes information such as the type of device you are using, its operating system, and mobile network information, which may include your mobile phone number. We may associate this device identifier with your personally identifiable information.
Location Information
We may collect and process information about the location of the device from which you are accessing the website. Location data may convey information about how you browse the website and may be used in conjunction with personally identifiable information.

With Trusted Service Providers and Business Partners.
We may utilize trusted third party service providers to assist us in delivering our website. For example, we may use third parties to help host our website, send out email updates, or process payments. These service providers may have access to your information for the limited purpose of providing the service we have contracted with them to provide. They are required to have a privacy policy and security standards in place that are at least as protective of your information as is this Privacy Policy. We may also store personal information in locations outside the direct control of Piper Jonas (for instance, on servers or databases co-located with hosting providers).
With Law Enforcement or In Order to Protect Our Rights.
We may disclose your information (including your personally identifiable information) if required to do so by law or subpoena.
In an Aggregate and Non-Personally Identifiable Manner.
We may disclose aggregate non-personally identifiable information (such as aggregate and anonymous usage data, platform types, etc.) about the overall use of our Service publicly or with interested third parties to help them understand, or to help us improve, the website.

We are not responsible for the practices employed by websites linked to from within the website, nor the information or content contained therein. Please remember that when you use a link to go from piperjonas.com to another website, our Privacy Policy is no longer in effect and your activities on that third party website is subject to such third party website’s own rules and policies.
Do Not Track Signals
Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. We currently do not respond to “do not track” signals.

If we change our Privacy Policy, we will post those changes on this page to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page.
